Ensuring that your products labelling is compliant with the relevant regulatory requirements is one of the most important steps of the compliance process.
Timeline to comply with the UK Cosmetics Regulation
Article 19(1)(a) of the UK Cosmetics Regulation foresees a five-yearĀ transition periodĀ for the labelling compliance of products that are placed on the UK market after 1 January, 2021.Ā This provision has beenĀ updatedĀ in September 2022: the original two-year grace period was extended to five years (until 31 December, 2025). This means that for five years after Brexit, products can continue being placed on the UK market with labels that are compliant in the EU. Products placed on the UK market prior to 1 January, 2021, and featuring compliant labels under the EU regulation can continue being sold on the UK market indefinitely.
New labelling requirements of the UK Cosmetics Regulation
The majority of the labelling requirements under the new UK cosmetics law are the same as those under theĀ EU law.
Hence, cosmetic labelling must display the following elements:
- Commercial name
- Product function
- Precautions for use
- Ingredients list
- Expiry date or Period After Opening (PAO)
- RP name and address
- Batch number
- Country of origin
- Nominal quantity
However:
- TheĀ country of originĀ must be stated on the label for all products manufactured outside of the UK. Consequently, the wording āMade in EUā is not compliant as the specific EU Member State must be specified (ex. āMade in Franceā).
- Inner and outer packaging must include the UK Responsible Person details (name and address).
