Since Brexit, the United Kingdom has adopted the same ingredient bans and restrictions as the European Union, with a few months delay. The Scientific Advisory Group on Chemical Safety of Non-Food and Non-Medicinal Consumer Products (SAG-CS) is the UK body that evaluates the safety of substances in cosmetic products. It has the same functions as the Scientific Committee on Consumer Safety (SCCS) in the European Union, and the UK legislator uses the SAG-CS conclusions to establish new restrictions. Until now, the SAG-CS conclusions mirror those of the SCCS.
News on the regulatory status of M-N-MA, Piperazine, and Piperazine (nano)
In the third quarter of 2022, the SAG-CS issued its final opinions on the following substances:
- Methyl-N-methylanthranilate (M-N-MA)
- Piperazine (nano), commonly known as HAA299 (nano)
- Piperazine
Considering the SAG-CS opinions, on July 6, 2023, the UK published the Cosmetic Products (Restriction of Chemical Substances) Regulations 2023. The statutory instrument implements the SAG-CS conclusions on the ingredients mentioned above in the UK Cosmetics Regulation.
The Regulation introduces the following novelties:
- Piperazine and Piperazine (nano) are allowed for use as UV filters up to a maximum concentration of 10% as of July 28, 2023. When they are used in combination, the sum shall not exceed 10%. Furthermore, the law provides additional requirements for Piperazine in nano form.
- Methyl-N-methylanthranilate (M-N-MA) has been added to the list of restricted substances. It will be allowed up to 0,1% in leave-on products and 0,2% in rinse-off products. Moreover, some extra restrictions
Beauty brands have time until July 6, 2024, to place on the UK market cosmetic products that do not comply with these restrictions. After this date, products not complying with new restrictions must be sold or recalled from the UK market before July 6, 2026.
