Manufacturers to benefit from an indefinite extension of the CE Marking in Great Britain

The UK announced today, on 1 August 2023, an indefinite extension of the CE marking for many products in Great Britain. These updates concern 18 different regulations. Among the products, there are toys, electronics (low voltage, radio equipment, and electromagnetic compatibility), simple pressure vessels, personal protective equipment (PPE), machinery, and equipment for potentially explosive atmospheres (ATEX).

Key information for UK manufacturers about prolonged CE mark recognition

Companies need to know that the new extension affect their activities in the Great Britain market. UK manufacturers with EU compliant products can still affix and use the CE marking in England, Scotland, and Wales. According to the announcement of the Department for Business and Trade (DBT), the 2024 deadline does not apply anymore and thus, manufacturers of products falling under the 18 DBT regulations will not be subject to the mandatory UKCA marking after December 2024. Notably, as per the Northern Ireland Protocol, Northern Ireland accepts both UKCA and CE marked products and all manufacturers with EU compliant products can access this market.

Not all CE marked products are subject to the extensions

The following products are subject to different rules and are thus currently not affected by the UK government’s announcement:

  • medical devices
  • construction products
  • cableways
  • transportable pressure equipment
  • unmanned aircraft systems
  • rail products
  • marine equipment
  • ecodesign

For medical devices, for instance, it is mandatory to have a UK Responsible Person already from January 2021 and medical devices placed on the Great Britain market must comply with the UK Medical Devices Regulations (UK MDR).
